Delaware rental property
Selling a rental property with tenants in Delaware
You don’t have to wait for a lease to end to sell a rental. Many Delaware rentals sell with the tenant in place, either to a buyer who wants an income property or to a cash buyer. Here’s what to know.
The lease and the deposit
In most cases the buyer takes the property subject to the current lease, and the security deposit and any prepaid rent are transferred or credited to the buyer at settlement, so the new owner holds them. Your attorney will confirm how the Delaware Residential Landlord-Tenant Code applies to your lease. Gather these before you list:
- the current lease and any renewals,
- the security deposit amount and where it’s held,
- rent history and any balances owed,
- repair records.
Showings and notice
Tenants have rights to reasonable notice before entry. Plan showings around their schedule, keep them few, and put the notice in writing. Fewer showings often means a smoother sale, which is one reason many owners consider a cash buyer or an investor who buys with the tenant in place.
Your options
| Sell with the tenant in place | Wait for vacancy, then list | |
|---|---|---|
| Rent | Keeps coming in | Stops once vacant |
| Price | Based on rent and condition | Can be higher after updates |
| Showings | Few | Many, on your schedule |
| Timing | Now | After the lease ends and the unit is prepped |
We’ll run both numbers, including what the rent is worth to a buyer and what it would cost to prepare the home once it’s vacant.
Frequently asked questions
Can I ask the tenant to leave so I can sell?
Only as the lease and Delaware law allow. Ask your attorney before you give any notice.
Will a buyer keep my tenant?
A buyer who wants an income property usually wants a paying tenant. It’s one of the home’s selling points.
What about rent paid in advance and the deposit?
They’re settled at closing, with credits to the buyer on the settlement statement.
